Yes Property & Finance Services · ABN 48 626 700 605 · Licensed Real Estate Agent, licence no. 4244439 · Credit Representative No. 495906 of Australian Finance Group Ltd, Australian Credit Licence 389087 · 7 Valentine Court, West End QLD 4810 · [email protected] · 0438 737 512
Version PCN-WR 1.3 · effective 22 October 2026. Please read this before you give us your buyer profile or sign the Prospective Buyer Agreement.
What we collect
Your contact details, the entity you’re buying through and your authority to sign for it, your budget and how you’ll fund the purchase, your experience and what you’re looking for, and your answers to the disclosure questions. Some of it comes from you now and some from public sources (such as ABN or ASIC searches). If you’re approved, we also collect:
- your signature and the signing record for the Prospective Buyer Agreement, through our own website signing page; and
- a War Room activity log: when you visit, which documents and pages you open, how long you spend, and the IP address and device used.
Why we collect it
- To assess your enquiry. Trent reviews every request personally; no computer program approves or declines you.
- To prepare the Prospective Buyer Agreement (a confidentiality agreement) and send it to you for e-signature.
- To give you view-only, watermarked access to the data room for that listing, and to protect the seller’s confidential information.
- To follow up with you about the business, and to meet our legal obligations (including identity checks under anti-money laundering law where a deal involves real estate).
If you don’t give us the required details, we can’t give you access to the War Room. You can still call Trent for a general chat.
Who we share it with
- The seller and their advisers (such as their solicitor or accountant): only when you ask us to, or when you progress to making an offer. Then we share a summary relevant to your offer: your name, the entity you’re buying through, a summary of your buying capacity and whether you’ve signed the agreement.
- Our service providers that run the form, e-signature and data room tools. Some are overseas, likely in the United States and/or the European Union (for example Cloudflare and Mailchimp in the United States). Our data room runs on Cloudflare, stored in its Oceania region, and you sign the agreement on our own website signing page, with no third-party e-signature provider.
- Regulators or authorities, if the law requires it.
Your rights
We keep War Room records, including the activity log and the signed agreement, for 7 years, then securely destroy them. Our Privacy Policy (yespf.com.au/privacy/) explains how to access or correct your information and how to complain to us and then to the OAIC (www.oaic.gov.au, 1300 363 992).
Your consent
Tick each box that applies. Boxes 1 to 3 are required for War Room access. Boxes 4 and 5 are optional and won’t affect your request.
- ☐ I’ve read this Privacy Collection Notice and the Privacy Policy. (required)
- ☐ Assess my enquiry. Yes Property & Finance can collect and use my details to assess this request. (required)
- ☐ War Room consent. If I’m approved, Yes Property & Finance can (a) use my details to prepare the Prospective Buyer Agreement and send it to me for electronic signature; (b) record my War Room activity (visits, documents and pages opened, time spent, IP address and device) and watermark documents with my name; and (c) disclose my details and a summary of my activity to the seller and their advisers, as this notice describes, including to service providers that may be overseas. (required for the War Room)
- ☐ Marketing. Add me to the Yes Property & Finance client database and send me Trent’s List and other marketing. I can unsubscribe at any time. (optional)
- ☐ Finance. Contact me about finance options. Finance broking is a separate service, provided as a Credit Representative of Australian Finance Group Ltd, whose privacy policy and credit guide apply. (optional)
We keep a record of what you agreed to, the notice version and when. You can withdraw an optional consent at any time. Withdrawing War Room consent ends your access, but it doesn’t undo a signed agreement or disclosures already made.
